What does this Privacy Statement cover?

This Privacy Statement provides information about personal data which is collected and processed when using the Timewise App by individual customers; why we are processing your personal information and for which purposes; how long we hold your personal information; how to access and update your personal information; the rights you have regarding your personal information; and where to go for further information.

When deploying the Timewise App, the Texas Petroleum Group, d/b/a Timewise Food Stores (“TPG” or “We”) may collect, store, and process information that is necessary for assessing the identity the user. When the Timewise App is used, TPG may collect and process location information of the Timewise App users in real time.

Personal information we collect

Personal information is information that identifies, relates to, or could be linked, directly or indirectly, with you. We may collect your personal information, including information about you as a user of the Timewise App. Below outlines the categories of personal information we may have collected in the preceding 12 months:

  • Your mobile phone number and date of birth.
  • Precise geolocation data may be collected from your device, with your permission, to help you locate and navigate to our gas stations using the embedded map feature in the app
  • From time to time, we may collect sensitive personal information, including precise geolocation, as detailed above and defined under applicable data protection laws.

In most cases, you are in control of the information you choose to provide to us; however, in some cases, your choice not to provide some information may impact your ability to interact fully with a Timewise App.

TPG does not knowingly collect, use, process, or disclose the personal information of children under 16 years old without parental consent.

From what sources do we collect your personal information?

  • Information that you provide to us – You may choose to provide personal information, including your mobile phone number and date of birth, when registering for the Timewise App.
  • Information that we obtain through your use of the Timewise App - We may also collect information about how you use the Timewise App, including the coupons you use.

Who is responsible for any personal information collected?

Texas Petroleum Group, LLC has offices at 1080 Eldridge Parkway, Suite 1400, Houston, TX 77077, USA on behalf of itself and the relevant Shell affiliates within the Shell group of companies.

Why do we process your personal information?

The personal information covered by this Privacy Statement is only processed:

  • to support the general operation and functionality of the app, including the availability of coupons to all users who register the account,
  • to support branded retail locations in offering general promotions and coupons available to all users of the app, without profiling or personalization,
  • where it is necessary for TPG to comply with a legal obligation,
  • with your explicit consent, if legally required to provide our services such as enabling location search functionality to identify and direct you to TPG retail branded locations and monitoring app use.

Where the processing is based on consent, you have the right to withdraw your consent at any time. This will not affect the validity of the processing prior to the withdrawal of consent.

How we use your personal information

We may process your personal information to:

  • provide our products and deliver our services, and otherwise manage our relationship with you,
  • analyze which products and services may be of interest to you and provide you with personalized offers and promotions,
  • enable account management including account verification,
  • support our customer service and development of our products and services,
  • perform and analyze market surveys and marketing strategies or conduct statistical, historical, marketing, or scientific research.

Additionally, specific uses of your personal information are as follows:

Precise Geolocation. When you permit us to collect your precise geolocation details, we may use this geolocation data to help you find the nearest TPG Station.

 

Disclosure of your personal information

We may share your personal information with:

  • Other companies within the Shell group of companies, including those outside your state or country of residence,
  • Service providers, contractors or sub-contractors, authorized agents, professional advisors, and external auditors,
  • Any person to whom TPG proposes to transfer any of its rights or duties,
  • As necessary or appropriate to enforce our terms and conditions, and to protect our rights, privacy, safety or property, or that of our affiliates, you, or others.

We do not sell your personal data or share it for targeted advertising purposes.

Your Rights and Choices

Depending on your jurisdiction of residence, you may have the right to:

  • Obtain confirmation that we maintain certain personal information relating to you and verify the content, origin, and accuracy of the personal information we hold about you,
  • Access your personal information,
  • Request the correction of your personal information,
  • Request deletion or portability of your personal information,
  • Only have your sensitive personal information, as defined in applicable law, processed with your consent.

Should you choose to exercise any of your rights as detailed above, we will not discriminate against you by offering you different pricing or products, or by providing you with a different level or quality of products, based solely upon this request.

The request must provide sufficiently detailed information for verification and to locate the personal information subject to the request. We may not be able to respond to your request if we cannot verify your identity or authority to make the request. If we need to request further information from you to verify your identity, we will only use that personal information for the purpose of identifying you or that you have authorized the request. In some states, you can designate an authorized agent to make a request on your behalf.

We will comply with your request as soon as reasonably practicable and as required by applicable law.
